Alenic’s Terms and Conditions (“Terms”) are incorporated herein by reference and are available online on the website www.vocafresh.com. All defined terms in the Privacy Policy shall have the same meaning as defined in the Terms. Alenic adheres to the following policies with regards to your privacy.

DEFINITIONS

A. "Non-Personal Information" is information that does not identify an individual and that is obtained automatically through your simple use of the Services.

B. "Personal Information" is any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data). It may include information such as name, address and email address. We do not process any of your sensitive personal information (known as “special categories” of data in the General Data Protection Regulation).

2

INFORMATION COLLECTED

When you enter the Websites, or use the Products, the Apps or the Services, we collect Non-Personal Information such as your browser type and IP address. Likewise, in order to offer you meaningful products and services and for other reasons, we may collect Personal Information about you from the following sources:

Information you give us on applications or other forms on the Websites, the Apps or the Services; or

Information you send us via any medium, including, but not limited to email, telephone, and social media interaction; or

If you use a mobile device platform to access the Websites, the Apps or the Cloud Services or communicate with Alenic, information transmitted from your mobile device; or

Information purchased from third parties (where permitted by applicable law).

Your use of and interaction with the Apps may also be stored in an anonymised form by us or our software partners.

A. Registration

In order to become a User (as defined in the Terms), you must provide us with a combination of the following information to create an account: name and email address, plus a username and password (your password is stored in an encrypted way that we cannot decipher). In the alternative, you may instead provide a link to your social media account to become a User, in which case we will receive basic information from your social media account including your name and email address. We may request other information from you during or after the registration process that we use to provide better and more customized services to Users. You acknowledge that this information is personal to you, and by creating an account on any of the Websites, the Apps or the Cloud Services, such as https://www.vocafresh.com, you may allow others, including Alenic, to identify you and to allow us to use your information in accordance with the Terms.

B. Customer Service

We collect information when you interact with our Customer Service in order to accurately categorize and respond to customer inquiries and investigate breaches of our terms.

C. Using Third Party Services and Visiting Third Party Websites

Information you provide to third‐party sites/websites through the Cloud Services is not within the control of Alenic and you provide such information at your own risk. The terms and conditions of use and the privacy policies of those websites that you provide information to through the Cloud Services will govern their use of such information. Any information you share with a third‐party website through the Cloud Services will be collected by Alenic and its affiliates (such as Alenic Ltd). We will use such information in compliance with this Privacy Policy.

D. Use of Cookies

The Websites (one or any of them) may send a "cookie" to your computer. A cookie is a small piece of data that is sent to your browser from a web server and stored on your computer's hard drive. A cookie cannot read data off your hard disk or read cookie files created by other websites. Cookies do not damage your system. Cookies allow us to recognize you as a user when you return to any of the Websites using the same computer and web browser. We use cookies to identify which areas of our Websites you have visited, so the next time you visit the Websites, those pages may be readily accessible. We also may use this information to better personalize the content that you see on the Websites. Most browser software can be set to reject Cookies. However, if you reject our Cookies, certain functionality on the Websites may not work correctly or at all. We do not link Non‐Personal Information from Cookies to your Personal Information. In the course of optimizing the Websites to our Users, we may allow authorized third parties to place or recognize a unique cookie on your browser. Any information provided to third parties through cookies will not contain Personal Information, but may provide general segment information for the enhancement of your user experience by providing more relevant advertising. Alenic does not store unencrypted Personal Information in the cookies.

E. Web Beacons

Alenic also may use web beacons, pixels, anonymous ad network tags, and cookies to collect Non‐Personal Information about your use of the Websites and the websites of selected sponsors and advertisers, to collect anonymized, aggregated auditing, research and reporting for advertisers, and to collect data related to your use of special promotions or newsletters. The information collected by web beacons also allows us to statistically monitor how many people open our emails and for what purposes these actions are being taken. Our web beacons are not used to track your activity outside of the Websites or the websites of our sponsors. We do not link Non‐Personal Information from web beacons to Personal Information without Your permission. However, because your web browser requests advertisements and web beacons directly from ad network servers, these networks can view, edit or set their own cookies, just as if you had requested a web page from their Websites. If you are a non‐registered Visitor to the Website, the only information we collect will be Non‐Personal Information through the use of cookies or web beacons.

F. Log files, IP Addresses and Information about Your Computer and Mobile device.

Due to the communications standards on the Internet, when you visit the Websites, the Apps or the Cloud Services, we automatically receive the URL of the site from which you came and the site to which you are going when you leave the Websites. Alenic also receives the internet protocol (“IP”) address of your computer (or the proxy server you use to access the World Wide Web), your computer operating system and type of web browser you are using, email patterns, your mobile device (including your UDID) and mobile operating system (if you are accessing the Websites using a mobile device), as well as the name of your ISP or your mobile carrier. We may also receive location data passed to us from third‐party services or GPS‐enabled devices that you have enabled. Also, as described above in Section 2. C., Alenic receives information when you access third‐party web pages through the Cloud Services. The link between your IP address and your Personal Information is not shared with third parties without your permission.

3

12

INTERNATIONAL TRANSFERS OF DATA

Alenic is headquartered in the United Kingdom. Personal Information may be accessed by us or transferred to us in the United Kingdom or to our affiliates, business partners, merchants, or service providers elsewhere in the world. We will protect the privacy and security of Personal Information according to our Privacy Policy, regardless of where it is processed or stored. We will also do our utmost to ensure that any Personal Information shared between Alenic and its subsidiaries is protected and secure during transfers.

If you are resident in the UK or European Economic Area, you should be aware that whenever we transfer your Personal Information out of the UK/EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

We may transfer your Personal Information to countries that have been deemed to provide an adequate level of protection for Personal Information by the European Commission.

Where we use certain service providers, we may use specific contracts approved by the European Commission which give Personal Information the same protection it has in Europe.

Where we use providers based in the US, we may transfer data to them if they are part of the Privacy Shield which requires them to provide similar protection to Personal Information shared between the UK/EEA and the US.

13

YOUR LEGAL RIGHTS

Under certain circumstances, you have rights under data protection laws in relation to your Personal Information, as set out below.

If you wish to exercise any of the rights set out below, please contact us using the contact details at the end of this privacy notice. We may not have to comply with your request but we would explain why if we believe we are entitled to refuse.

Request access to your Personal Information (commonly known as a "data subject access request"). This enables you to receive a copy of the Personal Information we hold about you and to check that we are lawfully processing it.

Request correction of the Personal Information that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

Request erasure of your Personal Information. This enables you to ask us to delete or remove Personal Information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your Personal Information where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your Personal Information to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request. If you would like to place a request for erasure you can contact us through our web form at www.vocafresh.com/support.

Object to processing of your Personal Information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your Personal Information for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

Request restriction of processing of your Personal Information. This enables you to ask us to suspend the processing of your Personal Information in the following scenarios: (a) if you want us to establish the data's accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

Request the transfer of your Personal Information to you or to a third party. Where our systems allow, we will provide to you, or a third party you have chosen, your Personal Information in a structured, commonly used, machine-readable format. Note that this right only applies to information which is processed by automated means. We do not currently hold Personal Information in a form that is readily portable and it is unlikely we would be able (or required) to comply with such a request.

Withdraw consent at any time where we are relying on consent to process your Personal Information. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain services to you. We will advise you if this is the case at the time you withdraw your consent.

No fee usually required

You will not have to pay a fee to access your Personal Information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

What we may need from you:

We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Information (or to exercise any of your other rights). This is a security measure to ensure that Personal Information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond

We try to respond to all legitimate requests within one calendar month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

14

YOUR ACCEPTANCE OF THIS PRIVACY POLICY

This is our entire Privacy Policy and it supersedes any earlier version. You agree to it every time you use the Cloud Services (which includes your use of the Websites, the Apps, the Products or the Cloud Services). If we make any material changes to this Privacy Policy, we will notify you by email or by posting a prominent notice on the Websites, the Apps or the Cloud Services prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy practices. Your continued use of the Cloud Services constitutes your agreement to be bound by such changes to this Policy. Your only remedy, if you do not accept the terms of this Policy, is to discontinue use of the Websites, the Products, the Apps and any of the Cloud Services.

15
